Kabahatler Kanunu'nun 17. maddesine ilişkin GİB kaynaklarında, ödeme süresi içinde yapılan peşin ödemenin kişilerin kanun yoluna başvurma hakkını etkilemediği açıkça yer alır. GİB'in trafik idari para cezası açıklama sayfası da trafik cezası karar tutanağına karşı tebliğ tarihinden itibaren 15 gün içinde sulh ceza hakimliğine başvurulabileceğini söylüyor. Bu nedenle cezanın ödenmiş olması tek başına itirazı otomatik olarak kapatmaz; asıl kritik nokta 15 günlük başvuru süresinin geçip geçmediği ve somut itiraz gerekçesinin bulunup bulunmadığıdır.
